Golden Retriever Puppy Contract
AGREEMENT
This Agreement ("Agreement") is made and entered into as of (the "Effective Date"), between Amanda Biglin and ("Buyer").
Buyer agrees to place a deposit of $500.00 (the "Non-Refundable Deposit") for the Golden Retriever puppy from the Breeder. The final amount due is $2000.00, bringing the total cost of the puppy to $2500.00. This total must be paid in full before the puppy leaves the Breeder's possession. This adorable puppy is proudly AKC registered meaning it meets the high standards set by the American Kennel Club. The puppy will come with AKC limited registration status, which provides the puppy with purebred registration with the American Kennel Club and can participate in competitions, dog shows, ext. AKC limited sets restrictions on breeding your Golden Retriever Puppy, and any litters that the purchased puppy produces will be unable to register for AKC status. If you’re interested in obtaining full registration rights, which would allow your puppy to participate in breeding future AKC litters, there will be an additional fee. This fee is required in addition to the puppy's purchase price and must be settled at the time of pick-up or drop-off. This arrangement ensures that both the lineage and quality of the puppies remain intact and are in line with AKC standards.
1. Non-Refundable Deposit: The Buyer acknowledges that the Deposit is non refundable in all circumstances other than outlined in Section 3, including if the Buyer decides they no longer want the puppy or is unable to take it. Upon receipt of the Deposit or full payment, the Breeders agree to hold the puppy for the Buyer until it has been weaned and is ready for pickup. All payments under this Agreement must be made in US dollars through an acceptable platform designated by the Breeder.
2. Buyer Acknowledgements: The Buyer acknowledges and agrees to the following conditions:
(a) Breeders cannot control the size of litters, and the wait time for puppies may be longer than expected.
(b) The deposit secures the Buyer a "pick hold" position and guarantees a puppy on a first-come, first-served basis.
(c) Breeders do not guarantee any specific traits or qualities of the puppy once it matures into an adult.
(d) The puppy will come with up-to-date vaccines; however, the breeder is not responsible for administering any further vaccinations. The breeder will inform you when the next rounds are due.
e)The puppy does not come with a microchip. If the Buyer wants one added, they must inform the breeder, as this will incur an additional fee of $50.00
3. Buyer's Right to Transfer: If the puppy becomes ill or passes away within one week of the buyer taking possession, or while still residing in the breeder's premises, the buyer may exercise the option to (a) transfer the deposit to a subsequent litter or (b) receive a full refund.
4. Refund at Breeder's Discretion: Once the Buyer has paid the full amount for the puppy and subsequently decides they no longer want the puppy for any reason after bringing it home: -
(a) The Breeder WILL NOT issue a refund. -
(b) If the puppy is already in the Buyer’s home, the Buyer MUST contact the Breeder to arrange for the puppy to be picked up and re-homed. Under NO circumstances can buyer sell the puppy. Under no circumstances will the breeder refund the Buyer’s deposit if the Buyer decides they no longer want the puppy while it is still with the Breeder. 5.If the puppy is returned to the breeder, a thorough evaluation of its condition will be conducted. This assessment will include a detailed examination of the puppy's physical health, looking for any signs of neglect or improper care, such as malnutrition, untreated health issues, or poor grooming. Depending on the findings regarding the puppy's overall appearance and health status, the breeder may pursue legal measures to address any violations of care obligations. This may involve reaching out to the puppy's previous owners to discuss the discrepancies and, if necessary, consulting with legal authorities to ensure that the welfare of the animal is prioritized.
6. Final Purchase Price: The Breeder and Buyer hereby establish the following terms concerning the purchase of the puppy:
(a) The deposit made will be deducted from the final purchase price of the puppy.
(b) The Buyer is required to pay the remaining balance of the purchase price in full before the puppy's drop-off or pick-up from the Breeder. The total purchase price for the puppy is $___2500____. Please be aware that this purchase excludes delivery fees.
7. The breeder retains the right to terminate this contract at any time if they feel uncomfortable due to unforeseen circumstances, a change in their capacity to care for the animals, or concerns regarding the buyer's suitability. In such cases, the buyer will promptly receive a full refund of the deposit paid for the puppy. The breeder will provide written notification to the buyer, clearly stating the reasons for the termination of the agreement to ensure full transparency and clarity in the process.
8. Governing Law: This Agreement, including all matters, disputes, or interpretations arising out of or related to its execution, performance, or breach, shall be governed by and construed by the laws of the State of Florida. This governance shall be without regard to any principles concerning conflicts of law that may lead to the application of the laws of any other jurisdiction. Both parties agree that any legal action or proceeding arising out of this Agreement shall be brought exclusively in the state or federal courts located in the State of Florida, and each party irrevocably consents to the jurisdiction of such courts for the resolution of any disputes.
One Year Genetic Health Guarantee
If the provided Golden Retriever puppy should develop a severe genetic disease before its 1st birthday and can no longer function as a Pet/Companion Animal the breeder will replace at no charge with a comparable Golden Retriever puppy or refund under the breeder's discretion. A proper letter from the vet stating the problem found and the vet's opinion on the viability of the animal must be sent to the seller within 15 days of diagnosis. The breeder will have the final say on whether the original Golden Retriever puppy must be returned or not. All the vet bills and returned shipping fees are the responsibility of the buyer and will NOT be accepted by the breeder.
• This guarantee does NOT include uneven bites, un-dropped testicles, umbilical hernia unable to produce puppies or show quality. Unless otherwise specified, all vet bills for corrective surgery, cosmetic surgery, shots and normal health care, euthanasia, spay/neuter and shipping are the responsibility of the buyer.
• Stress can bring out certain treatable conditions that would not be included as a reason for a Golden Retriever puppy’s return. Puppies are naturally at risk for coccidia, giardia, or worms which are often brought on by the stress of a new home, new food, new people, or just a change in environment. This includes but is not limited to worms, fleas, mites, coccidia, giardia, or any other parasites as they can sometimes be common in dogs and puppies.
